Latest 2026 EB-5 Priority Date Data

As of the April 2026 Visa Bulletin, EB-5 category statuses are: Rural Set-Aside — Current, no waiting required; High Unemployment TEA Set-Aside — Current; Infrastructure Project Set-Aside — Current; Unreserved China-born — Final Action Date around March 2016, advancing approximately 2-4 weeks per month. India-born unreserved dates are also beginning to show retrogression pressure. All other countries of birth remain Current across all categories.

Dates for Filing vs Final Action Date

Status Maintenance During the Wait

During extended priority date waits, investors must address status issues: those in the U.S. should maintain valid nonimmigrant status through H-1B, L-1, or other classifications; EAD and AP obtained after I-485 filing provide additional flexibility; investment capital must remain continuously "at risk" throughout the waiting period and cannot be withdrawn early.
