In 2026, the EB-5 landscape is bifurcated: rural and high-unemployment set-aside categories remain "Current" (no backlog), while unreserved categories for China-born applicants advance at a glacial pace. Understanding the latest EB-5 priority date trends in 2026 is essential for making informed investment decisions and filing strategies.

Latest 2026 EB-5 Priority Date Data

As of the April 2026 Visa Bulletin, EB-5 category statuses are: Rural Set-Aside — Current, no waiting required; High Unemployment TEA Set-Aside — Current; Infrastructure Project Set-Aside — Current; Unreserved China-born — Final Action Date around March 2016, advancing approximately 2-4 weeks per month. India-born unreserved dates are also beginning to show retrogression pressure. All other countries of birth remain Current across all categories.

EB-5 Priority Date Trend Analysis

Historical data shows China-born unreserved dates have advanced an average of 2-3 weeks monthly over the past year, totaling roughly 6-8 months annually. At this rate, applicants with current priority dates in March 2016 may wait an additional 8-10 years. In contrast, the three set-aside categories created by the 2022 EB-5 Reform Act (20% rural, 10% high unemployment, 2% infrastructure) remain current because demand has not exceeded supply. This window is extremely attractive for new investors.

Dates for Filing vs Final Action Date

Understanding the two charts is critical for filing strategy. "Dates for Filing" is typically earlier than "Final Action Date," allowing applicants whose dates are not yet fully current to file I-485 adjustment of status in advance. Each month after the State Department publishes the bulletin, USCIS confirms which chart applies for I-485 filing. Check the USCIS "When to File" page monthly to seize early filing opportunities. Benefits of early I-485 filing include obtaining an EAD work permit, Advance Parole travel document, and CSPA age lock for children.

Investment Category Selection Strategy

Based on current priority date conditions, we recommend: (1) New investors should prioritize rural TEA projects — currently no backlog with retrogression unlikely in the near term, making this the fastest EB-5 path to a green card; (2) High unemployment TEA projects as an alternative — also current, but with a smaller visa reserve (10%), these may develop backlogs first; (3) Unreserved categories suit existing applicants already in the queue — new investors entering this category face 10+ year waits; (4) For families with children approaching age 21, selecting a current category is the key strategy for protecting children's eligibility.

Status Maintenance During the Wait

During extended priority date waits, investors must address status issues: those in the U.S. should maintain valid nonimmigrant status through H-1B, L-1, or other classifications; EAD and AP obtained after I-485 filing provide additional flexibility; investment capital must remain continuously "at risk" throughout the waiting period and cannot be withdrawn early.
