In March 2026, USCIS announced a series of policy updates affecting processing times, fees, and operational procedures. Here is a summary of the month's most significant changes.
Processing Time Updates
H-1B regular processing is now 4-6 months, with Premium Processing maintaining its 15 business-day timeline. I-140 Premium Processing remains at 45 days. EB-5 I-526E average processing is approximately 24-36 months, though rural category processing times have shortened significantly.
Fee Adjustments
USCIS implemented new fee structures: I-129 (H-1B) filing fee adjusted to $780, I-140 filing fee adjusted to $715, I-485 filing fee adjusted to $1,440. Premium Processing fee is $2,965.
Biometrics Process Updates
USCIS continues expanding its biometrics reuse policy. Some applicants may no longer need to provide new fingerprints. Those with valid biometrics on file will be processed directly, reducing wait times.
Premium Processing Expansion
Premium Processing has been extended to additional application categories. I-539 (Extension/Change of Status) and I-765 (EAD) Premium Processing options are now formally available with a 30 business-day processing time.
