Overview

EB-4 is the fourth preference employment-based immigrant visa category, providing green card pathways for various "special immigrants." The most common EB-4 subcategory is Religious Workers (filed on Form I-360), which includes ministers, religious professionals, and individuals in religious vocations. Other EB-4 categories include: Special Immigrant Juvenile Status (SIJS), U.S. government employees abroad, retired international organization employees, members of the U.S. Armed Forces, Iraqi/Afghan translators, and more. The EB-4 category has approximately 10,000 visa numbers available annually, with religious workers comprising a significant portion.

Eligibility Requirements (Religious Workers)

  • Must have been a member of a religious denomination and continuously engaged in religious work for at least 2 years immediately preceding the petition
  • The position in the U.S. must be as a minister, in a religious vocation, or in a religious occupation
  • A bona fide job offer from a tax-exempt religious organization lawfully operating in the U.S.
  • The religious organization must be an IRS-recognized 501(c)(3) tax-exempt entity or otherwise qualify for tax exemption
  • (Non-minister categories) The applicant must hold a bachelor's degree or equivalent related to the religious occupation, or have been continuously engaged full-time in the religious function for at least 2 years prior to the petition

Application Process

Prepare Documentation

Gather the religious organization's tax-exempt certification, evidence of the applicant's work within the organization, proof of ability to compensate, and the applicant's educational/training records.

File Form I-360

The religious organization (employer) or the applicant files Form I-360 (Special Immigrant petition) with USCIS along with all supporting documentation.

Await Adjudication

USCIS reviews the petition and may conduct a worksite inspection (Site Visit). Religious worker petitions are subject to heightened scrutiny.

File I-485 or Consular Processing

After I-360 approval, if in the U.S. with a current priority date, file Form I-485 for adjustment of status; if abroad, proceed through NVC consular processing.

Receive Green Card

Upon approval, the applicant receives permanent resident status. Religious worker green cards are not conditional.

Is there an annual cap for EB-4 religious workers?

The EB-4 category has approximately 10,000 visa numbers per year. The non-minister religious worker subcategory has an additional annual sublimit of approximately 5,000. Ministers are not subject to this sublimit but are counted under the overall EB-4 cap. Currently, EB-4 priority dates are Current for most countries, though China- and India-born applicants may experience brief backlogs.

Do EB-4 religious workers need PERM labor certification?

No. The EB-4 religious worker category does not require PERM labor certification, which is a significant advantage over EB-2/EB-3. The employer files Form I-360 directly without needing to prove to the Department of Labor that no qualified U.S. workers are available. However, USCIS scrutinizes religious worker petitions very closely, particularly regarding the authenticity of the religious organization and the continuity of the applicant's religious work.

What other EB-4 categories exist?

Beyond religious workers, EB-4 categories include: (1) Special Immigrant Juvenile Status (SIJS) — minors determined by a U.S. court to have been abused, neglected, or abandoned; (2) certain long-term employees of U.S. diplomatic missions abroad; (3) retired employees (and family members) of international organizations (e.g., United Nations, World Bank); (4) noncitizens serving in the U.S. Armed Forces; (5) former Panama Canal Zone employees; (6) Iraqi/Afghan translators (SIV program). Each subcategory has distinct eligibility criteria and procedures.

Is Premium Processing available for EB-4 religious workers?

Premium Processing is not available for the EB-4 I-360 petition. Applicants must wait through regular processing times. However, after I-360 approval, if filing I-485 adjustment of status, it may be possible in certain circumstances to request expedited processing from USCIS (e.g., for urgent travel needs), though this is discretionary.
