Overview

The O-1A visa is for individuals with extraordinary ability in the sciences, education, business, or athletics. Applicants must demonstrate they are among the "small percentage who have risen to the very top" of their field by meeting at least 3 of 8 evidentiary criteria. The O-1A has no annual cap, no lottery, an initial validity of up to 3 years, and unlimited extensions. It is commonly used as a premium alternative to H-1B and as a bridge to the EB-1A green card.

Frequently Asked Questions

O-1A vs H-1B?

O-1A has no cap (no lottery), a higher bar than H-1B but no 6-year limit, and unlimited extensions. Ideal for those with significant professional achievements.

Are O-1A and EB-1A standards the same?

O-1A has 8 criteria (meet 3), EB-1A has 10 criteria (meet 3). In practice, O-1A is considered slightly lower threshold. Many applicants get O-1A first, then pursue EB-1A green card.

Is O-1A suitable for STEM researchers?

Highly suitable. Publications, citations, peer review experience, and research awards are strong O-1A evidence. STEM professionals often naturally meet multiple criteria.

Can O-1A be self-sponsored?

Not directly, but applicants can use an agent as petitioner. If you own a U.S. company, it may serve as petitioner under certain conditions.

Is Advisory Opinion required?

Yes, all O-1 petitions require an Advisory Opinion Letter from a relevant peer group organization. If no applicable organization exists, USCIS may accept substitute evidence.

O-1A processing time?

Regular processing takes 3-5 months. Premium Processing guarantees a response within 15 business days.
