Overview

The P-1B visa is for individuals who are members of an internationally recognized entertainment group coming to the United States to perform. P-1B does not apply to individual entertainers — the applicant must be a member of an entertainment group that has been established for at least 1 year and is internationally recognized as outstanding in its discipline for a sustained and substantial period. At least 75% of the group's members must have maintained a sustained relationship with the group for at least 1 year. The initial period of stay is for the duration of the event (typically up to 1 year), with extensions available up to a maximum cumulative stay of 10 years. A labor organization consultation is required.

The U.S. employer, agent, or sponsoring organization files Form I-129 (P-1B classification) with USCIS. Multiple group members may be included on a single petition.

Frequently Asked Questions

Does P-1B apply to individual performers?

No. P-1B applies only to members of entertainment groups, not individual performers. Individual artists and entertainers should consider the O-1B visa (extraordinary achievement in the arts/film and television). O-1B has a higher threshold but broader applicability.

What does the 75% membership requirement mean?

At least 75% of the group's members must have maintained a sustained and substantial relationship with the group for at least 1 year. For example, if a band has 4 members, at least 3 must have been with the band for at least 1 year. If the group has recently replaced a large number of members, it may not meet P-1B eligibility. New members constituting up to 25% of the group do not affect the group's overall qualification.

What is the difference between P-1B and O-1B?

P-1B applies to "members of internationally recognized entertainment groups"; O-1B applies to "individual artists or film/TV professionals with extraordinary achievement." P-1B is a group classification; O-1B is individual. O-1B requires a higher standard ("extraordinary achievement"); P-1B requires "international recognition." O-1B can be extended indefinitely; P-1B has a 10-year maximum. Individual performers must use O-1B; group members may choose P-1B.

What visa do P-1B dependents receive?

The spouse and unmarried children under 21 of P-1B members may apply for P-4 visas. P-4 holders may reside in the United States and attend school but may not work.
