Overview
The L-1A visa is for intracompany transferees in managerial or executive capacity, allowing transfer from an overseas affiliated company to a U.S. subsidiary, branch, or affiliate. L-1A has a maximum validity of 7 years, is not subject to an annual cap, and most importantly, L-1A holders can directly apply for the EB-1C green card (first preference, no PERM required). For companies that have not yet established a U.S. presence, L-1A supports "New Office" petitions with an initial 1-year approval.
L-1A Eligibility Requirements
- At least 1 year of continuous employment in a managerial or executive role at an overseas affiliate within the past 3 years
- Managerial Capacity: supervises and manages professional staff, or manages an essential function of the organization
- Executive Capacity: directs management of the organization, establishes goals and policies, exercises wide latitude in discretionary decision-making
- Qualifying relationship between the U.S. and foreign entity (parent, subsidiary, branch, or affiliate)
- Will serve in a managerial or executive capacity at the U.S. entity
- New Office: detailed business plan demonstrating ability to support a managerial/executive role within 1 year
Application Process

Prepare Petition Package
Organizational charts, job descriptions, evidence of managerial experience, business plan (for new offices).
File Form I-129
Submit Form I-129 with L classification supplement. Premium Processing available.

Regular processing 3-5 months, Premium Processing 15 business days. RFE possible.
Visa/Entry
Upon approval, attend consular interview or change status within the U.S.

What qualifies as "managerial capacity"?
USCIS defines managerial capacity as: managing the organization or a department/subdivision/function; supervising and controlling the work of other managers, professionals, or functions; authority to hire and fire or recommend such action; exercising discretion over day-to-day operations.
What does L-1A new office extension require?
Evidence of substantial business growth: actual employees and organizational structure, revenue and client contracts, operational office space. If the company has only the applicant and no revenue after one year, extension will likely be denied.
Does L-1A have a wage requirement?
No. Unlike H-1B, L-1A has no prevailing wage requirement. However, compensation should be commensurate with a managerial/executive position — unusually low salaries may cause USCIS to question the legitimacy of the role.
