Overview

The O-1B visa is for individuals with extraordinary ability in the arts or extraordinary achievement in the motion picture or television industry. This covers professionals in visual arts, music, performing arts, film, television, fashion design, and related fields. O-1B uses a different set of 6 evidentiary criteria (meet at least 3) than O-1A. A Consultation Letter from the relevant labor union or peer group is a mandatory requirement unique to O-1B petitions.

Application Process

Attorney evaluates whether applicant meets at least 3 of 6 criteria and develops evidence strategy.

A U.S. employer or agent must serve as petitioner. Artists typically use an agent.

Obtain Consultation Letter

Must obtain a Consultation Letter from relevant union or peer group (e.g., SAG-AFTRA for film/TV, AFM for music).

Compile evidence (portfolio, reviews, awards), recommendation letters, itinerary, and contracts.
