L-2 Dependent Visa

The L-2 visa is for spouses and unmarried children (under 21) of L-1 (L-1A or L-1B) principal workers. L-2 spouses may apply for EAD (I-765) for work authorization without additional conditions (unlike H-4 EAD, no approved I-140 required). L-2 status validity mirrors the L-1 principal.

Confirm principal's L-1 (A or B) status is valid. Verify spousal/parent-child relationship (marriage certificate, birth certificate). L-2 spouses are automatically eligible for EAD without additional requirements.

L-2 EAD is much more accessible than H-4 EAD — no I-140 approval needed. All L-2 spouses are eligible.

2File I-539 + I-765

File I-539 (L-2 status) + I-765 (L-2 EAD) concurrently with L-1 petition, or separately after L-1 approval. Include relationship proof, principal's I-797, passports.

1Provide Principal's Documentation

Provide copy of L-1 employee's I-797 Approval Notice. If L-2 is filed concurrently with L-1, indicate dependent on I-129.

2Understand L-2 Work Rights

L-2 spouses with EAD can work for any employer (not limited to L-1 employer), including self-employment. Employer has no obligation regarding L-2 spouse's employment.

1Prepare Personal Documents & Relationship Proof

Provide: passport, marriage certificate (spouse) or birth certificate (child), principal's L-1 I-797 copy, I-94, passport photos.

2Apply for L-2 EAD (I-765)

File I-765 for work authorization (category: (a)(18)). No additional requirements like I-140 approval needed. Processing approximately 2-5 months. Upon receiving EAD card, may work for any employer or self-employ.

L-2 EAD validity mirrors L-2 status. File I-765 renewal up to 180 days in advance. Set calendar reminders to prevent lapses. L-2 EAD also qualifies for auto-extension rule.

4Status Transition Planning

If L-1 principal plans to apply for green card (L-1A → EB-1C or PERM → EB-2/EB-3), L-2 spouse can be derivative beneficiary for concurrent green card. Plan I-485 concurrent filing in advance.

3Include Dependents in Extension

When extending L-1, remember to extend L-2 dependents simultaneously. L-2 cannot extend beyond L-1 principal. Remind attorney to process together.

4Family Relocation Support

Provide relocation support information to help employee's family adjust. L-2 spouse's ability to work is a major advantage that helps the employee focus on their role.

3Maintain Status & Travel

L-2 status is tied to L-1 principal. Travel requires valid L-2 visa stamp. If expired, must obtain new stamp at consulate. Note: L-2 visa interview typically requires principal's L-1 documents.

4EAD Renewal & Green Card Planning

File EAD renewal 180 days before expiry. If principal is in green card process (EB-1C or PERM), you benefit as a derivative. During I-485 phase, you can receive combo card (EAD + AP).
