O-1B Extraordinary Ability (Arts)
Work visa for individuals with extraordinary achievement in the arts (including motion picture/TV)
The O-1B visa is for individuals with extraordinary achievement (distinction) in the arts (including motion picture/TV industry). The standard is "distinction" (slightly lower threshold than O-1A's extraordinary ability). Special criteria apply for motion picture/TV. Must obtain advisory opinion from relevant labor union or peer group. Detailed itinerary required.

Arts (non-film): meet at least 3 of: (1) Lead/starring role in distinguished productions/events (2) National/international recognition via reviews/media (3) Lead/critical role at distinguished organizations (4) Record of major commercial or critically acclaimed success (5) Significant recognition from organizations/critics/experts (6) High salary. Motion picture/TV: different standard requiring "extraordinary achievement," with evidence like major award nominations/wins.
Motion picture/TV O-1B standard is higher than general arts. If beneficiary is in film/TV, must show achievement at the top of the industry.
Must obtain advisory opinion from the labor union or peer group in the beneficiary's art field. Common organizations: SAG-AFTRA (film/TV), AFM (music), AGMA (opera/dance). For non-union fields, find relevant professional organizations. The advisory opinion significantly impacts the case.

O-1B advisory opinion is typically more critical than O-1A's, as unions may issue "no objection" or "objection." Prepare thorough materials for the union's review.
O-1B is typically filed through an agent (especially for freelance artists). If there is a primary employer (e.g., record label, gallery), they may petition directly. Multiple employers require an agent. Prepare agent agreement or employment contract.
Provide all confirmed performance, exhibition, recording contracts (with dates, venues, compensation). These form the basis of the itinerary. If some events are not yet finalized, provide letters of intent/invitations.
Compile comprehensive arts career portfolio: award history, list of major performances/exhibitions, media reviews and coverage, portfolio/video/audio samples, box office/sales data (if applicable).
Contact prominent figures in your field for recommendation letters. Assist attorney in submitting materials to union/industry organization for advisory opinion. Provide complete CV, works list, award history for union review.
Complete I-129 + O/P Classification Supplement. Draft Petition Letter. O-1B has stricter itinerary requirements — must detail all performances/exhibitions/events during US stay (dates, venues, activity descriptions).
File I-129. Common O-1B RFEs: insufficient itinerary detail, advisory opinion with reservations, evidence insufficient to prove distinction. If union issues "adverse" opinion, must provide additional argument to overcome.
Issue Support Letter describing: relationship with beneficiary, beneficiary's distinction in the arts, planned activities/projects, why the beneficiary's personal involvement is necessary.
Sign I-129 and G-28. O-1B does not require LCA or ACWIA/Fraud Prevention fees. If O-2 support personnel needed, file additional I-129.
Confirm all planned US activities and provide to attorney. If performance/exhibition contracts exist, ensure dates and details are accurate. If some events are still being negotiated, obtain letters of intent or invitations.
Visa officer may ask about your art field and achievements during the interview. Prepare to describe your representative works, awards, and planned US activities concisely. Bring originals of I-797, contracts, invitation letters.
If you have visual works (videos, photos, catalogs), you may bring a few samples or show on a tablet — but visa interviews are short, so prepare highlights only.
After approval, assist with visa stamping. If support personnel (assistants, technicians) are needed, O-2 visa can be filed simultaneously. O-2 requires showing the person is essential to the O-1B holder's activities and has a foreign residence.
