O-1A vs O-1B

The O-1 has two subcategories. O-1A is for "extraordinary ability" in the sciences, education, business, or athletics, with criteria closely mirroring the EB-1A green card. O-1B is for "extraordinary achievement" in the arts, including the motion picture and TV industry, with a different evidentiary focus. Identifying which one fits you is the first step — submitting evidence built for the wrong subcategory is a common denial reason.

The 8 O-1A Criteria (Meet at Least 3)

You must satisfy at least three of: (1) nationally or internationally recognized awards or prizes; (2) membership in associations requiring outstanding achievement, judged by experts; (3) published material about you and your work in professional or major media; (4) judging the work of others in your field; (5) original scientific, scholarly, or business contributions of major significance; (6) authorship of scholarly articles; (7) a leading or critical role at distinguished organizations; and (8) high salary or remuneration relative to others in the field. Meeting the count is only step one — USCIS also makes a holistic "final merits determination" of whether the evidence truly reaches the "extraordinary" level.

O-1B: The Arts and Film/TV Standard

O-1B focuses on artistic achievement: having performed or being set to perform a lead or starring role in distinguished productions or events; significant critical recognition or reviews; a record of major commercial or critical success; recognition from authoritative organizations, critics, or experts; and high remuneration relative to peers. For motion picture and TV applicants, the criteria also include receipt of or nomination for major awards such as the Oscars, Emmys, or Grammys. Arts cases rely especially on strong "lead role" and "critical recognition" evidence.

Required: The Advisory Opinion

Every O-1 petition must include an advisory opinion — from a peer group, labor union, or management organization in your field — assessing your ability and achievements. Where no suitable organization exists, individual expert opinion letters may substitute. Turnaround ranges from 2 to 6 weeks across organizations, so start early to avoid delaying the whole case. While not legally binding on USCIS, an authoritative, favorable advisory opinion meaningfully strengthens the petition.

Who Petitions: Employer or Agent
