PERM Labor Certification
Prerequisite for EB-2/EB-3 immigration, proving no qualified US workers available
PERM (Program Electronic Review Management) is the DOL-administered labor certification process. The employer must demonstrate: (1) good faith recruitment for qualified US workers through prescribed methods; (2) no qualified, willing US worker was found; (3) hiring the foreign worker will not adversely affect wages and working conditions of similarly employed US workers. Only after PERM approval can the I-140 immigrant petition be filed. Priority date = PERM filing date.
Overall Workflow
Analyze job duties to determine the most appropriate SOC Code (Standard Occupational Classification). Define minimum requirements (education, experience, skills, special requirements). Requirements must be industry standard, not tailored for the beneficiary. If special requirements exist (language, special skills), prepare business necessity justification.
1-2 weeks
SOC Code selection directly affects Prevailing Wage level and EB-2/EB-3 classification. Wrong choice can lead to PERM denial or excessive wage.
Submit ETA-9141 to DOL National Prevailing Wage Center. Provide: SOC Code, job description, worksite (precise to MSA), minimum education and experience. DOL returns the applicable wage level from 4-tier wage structure. PWD valid for 1 year from determination date.
6-12 months
Work with attorney to define minimum job requirements (education, years of experience, skills). Requirements must reflect genuine business needs, not tailored for the beneficiary. Confirm willingness to pay at least Prevailing Wage. Prepare detailed job description (JD).
All PERM costs (including attorney fees, advertising, government fees) must be paid by the employer. Cannot require the beneficiary to pay any PERM-related costs.
Execute recruitment per attorney timeline: (1) Place SWA Job Order (30 days); (2) Place two Sunday newspaper ads; (3) Post on company website; (4) Post internal notice at worksite (10 business days); (5) Complete additional recruitment steps (professional positions need 3 extra channels). All advertising costs paid by employer.
2-4 months
Provide attorney with complete personal information: education (degree certificates, transcripts), work history, current immigration status, passport details. Foreign degrees require credential evaluation.
Contact former employers for experience verification letters. Each letter must include: company letterhead, employment dates, job title, specific duties (corresponding to job requirements), full-time/part-time, signatory name/title/contact info. If former employer cannot provide, former colleague/supervisor may write it.
After receiving PWD, complete all recruitment within 180-day window: (A) Mandatory steps: (1) SWA Job Order — minimum 30 days; (2) two Sunday newspaper ads — different dates; (3) internal company posting — minimum 10 business days. (B) Additional 3 steps for professional positions (EB-2/EB-3 Professional/Skilled): company website, professional journal, campus recruiting, headhunter, employee referral program, local/ethnic newspaper, etc. (choose 3). Ad content must include: company name, position, requirements, worksite, how to apply.
2-4 months
Critical timeline: all recruitment must be completed within 180-day window. Must wait 30-day cooling period after last recruitment step before filing PERM. PWD valid for 1 year — don't let it expire.
Document each recruitment step in detail: date, method, ad content, number of resumes received, screening process and result for each applicant, rejection reasons. Legitimate rejection: doesn't meet minimum education/experience, no work authorization, salary demand out of range, no response, declined offer. Illegitimate: less capable than beneficiary, overqualified.
Genuinely review each resume received. Interview or phone screen candidates meeting minimum requirements. Document review results and rejection reasons for each candidate (must be legitimate). Submit all records to attorney for filing.
Review all information on ETA-9089, sign after confirming accuracy. There is no government filing fee for the ETA-9089 — the Department of Labor charges none. Sign declarations: good faith recruitment conducted, no qualified US worker found, will pay at least PWD salary.
Critical reminder: absolutely do not participate in any aspect of PERM recruitment. Do not screen resumes, do not interview candidates, do not influence hiring decisions. If DOL finds the beneficiary participated in recruitment, PERM will be denied.
Review your personal information in ETA-9089: education, work experience, current status, prior visa denials, etc. Sign Section J (beneficiary declaration) after confirming accuracy. Any false information may result in permanent inadmissibility.
Information on ETA-9089 must be 100% truthful and accurate. USCIS and DOL may cross-verify.
After 30-day cooling period, electronically file ETA-9089 via DOL PERM Online system. Form includes: employer information, job information (SOC Code, requirements, salary), beneficiary information (education, experience, current status), recruitment summary. Filing date = Priority Date.
6-18 months processing (no audit), 12-24 months (with audit)
DOL audit probability ~20-30%. Must provide all original recruitment documents within 30 days of Audit Notice. If Supervised Recruitment, must re-recruit under DOL supervision. I-140 must be filed within 180 days of PERM approval. PERM approval notice and all recruitment records must be retained for at least 5 years.
After PERM denial, can appeal to BALCA within 30 days, but success rate is low. Ensure all documents are flawless before filing.
If DOL issues Audit Notice, provide all original recruitment documents to attorney within 30 days. Including: newspaper ad originals/invoices, SWA confirmation, internal posting photos, all resumes, interview records, rejection notices. All PERM records must be retained for at least 5 years.
Recommend creating a dedicated PERM folder, keeping originals and copies of all documents from day one.
