Overview

An H-1B visa is initially valid for 3 years and can be extended once for a total of up to 6 years. After the 6-year maximum, the worker generally must leave the U.S. for at least one year before re-applying for H-1B status. However, under the AC21 Act, if the beneficiary has filed a PERM labor certification before the end of the 5th year in H-1B status, or has an approved I-140 immigrant petition, they may extend H-1B status beyond the 6-year cap in increments of 1 year or 3 years. This allows H-1B holders awaiting green card processing to continue working legally in the United States.

The position continues to qualify as a "specialty occupation"

Extensions within 6 years: the employer simply files a new I-129

Extensions beyond 6 years (AC21 §106): a PERM application must have been filed at least 365 days before the H-1B 6-year expiration

Extensions beyond 6 years (AC21 §104(c)): an approved I-140 allows 3-year extensions

Application Process

Determine Extension Eligibility

Confirm current H-1B validity dates and whether the extension is within the 6-year cap or requires AC21 provisions for beyond-6-year extensions.

LCA Update

If the position, work location, or salary has changed, a new LCA must be filed with the DOL. If unchanged, the existing LCA may be used.

File Form I-129

The employer files the I-129 extension petition with supporting documents. For beyond-6-year extensions, include PERM receipt or I-140 approval notice.

Await Adjudication

Approval and Continuation

Upon approval, a new I-797 approval notice is issued, extending H-1B status to the new validity date.
